TERMS AND CONDITIONS

ACCEPTANCE
Thank you for choosing the GeoSwipe app. The GeoSwipe mobile application ("GeoSwipe", "App", "Service", "we", "us" or "our") is accessible through the Apple App Store and is owned and operated by ELM APPS LTD.
These Terms and Conditions ("Terms") govern your access to and use of GeoSwipe, including its country guides, maps, quizzes, learning games, audio overviews, offline downloads, country comparison tools, regional maps and quizzes, premium features, subscriptions, lifetime purchases, and any related services made available through the mobile application.
Our Services are offered subject to your acceptance without modification of these Terms and any other applicable policies, including the GeoSwipe Privacy Policy, that may be published or updated from time to time.
By downloading, installing, accessing, or using GeoSwipe, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App and should delete it from your device.
BY DOWNLOADING, INSTALLING, ACCESSING, OR USING GEOSWIPE, YOU AFFIRM THAT YOU ARE AT LEAST 16 YEARS OF AGE, OR THAT YOU ARE USING THE APP WITH THE CONSENT AND SUPERVISION OF A PARENT OR LEGAL GUARDIAN WHERE REQUIRED.
If you download the mobile application from Apple’s App Store, Apple’s Standard End User Licence Agreement ("Apple Standard EULA") shall apply to your use of the mobile application in addition to these Terms. Where Apple’s terms apply to matters required by Apple, Apple’s terms will control. Otherwise, these Terms apply between you and us.

In these Terms, "you" means any person who downloads, accesses, or uses GeoSwipe, including free users, subscribers, and users who purchase Lifetime Access.
UPDATES
These Terms constitute a contractual agreement between you and ELM APPS LTD.
We reserve the right to update, amend, or replace these Terms from time to time. Where appropriate, we may notify you of material changes through the App, App Store listing, or another reasonable method.
Your continued use of GeoSwipe after the effective date of updated Terms means that you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the App and, where applicable, cancel any active subscription through your Apple ID subscription settings.
We may also update, modify, improve, remove, replace, suspend, or discontinue any feature, content, database, guide, quiz, map, image, audio file, learning game, graph, comparison tool, or other part of GeoSwipe at any time, with or without notice, where reasonably necessary to improve the App, correct errors, maintain security, comply with law, address licensing or technical issues, or update educational content.
THE GEOSWIPE MOBILE APPLICATION
Subject to your compliance with these Terms, ELM APPS LTD grants you a personal, limited, revocable, non-exclusive, non-transferable licence to install and use GeoSwipe on Apple devices that you own or control, in accordance with these Terms and Apple’s Standard EULA.
GeoSwipe is a geography learning app designed to help users explore countries and territories through an interactive, swipe-based experience. The App may include:
- a world map and country exploration interface;
- country cards with flags, country names, regions, capitals, population, currency, coordinates, driving-side information, and other facts;
- detailed country guides;
- country images;
- flag descriptions;
- country and regional maps where available;
- quizzes and learning games;
- experience points, levels, ranks, and progress tracking;
- audio overviews;
- offline downloads;
- country comparison tools;
- interactive graphs and data visualisations;
- a learning hub with country search, quizzes, mini-games, and related learning features;
- optional feedback tools.
GeoSwipe is intended for personal, non-commercial, educational, and informational use only.
We may modify, suspend, withdraw, restrict, or replace any feature or service within the App at any time. Such changes may be made to improve functionality, maintain security, comply with applicable laws or regulations, update content, address errors, manage licensing issues, or improve user experience.
GEOSWIPE FREE FEATURES AND PREMIUM FEATURES
GeoSwipe may offer both free features and paid Premium features.
Free features may include access to country guides, basic country exploration, country search, world map exploration, country facts, images, flag descriptions, guide text, and selected quizzes or learning features. The exact free features available may change over time.
Premium features may include, but are not limited to:
- audio overviews;
- offline downloads;
- regional maps where available;
- regional quizzes where available;
- country comparison tools;
- extended or advanced mini quizzes;
- additional learning tools, data views, or premium features made available in the App.
Premium access may be offered through a yearly auto-renewing subscription, a one-time Lifetime Access purchase, free trials, introductory offers, promotional offers, or other purchase options shown in the App.
We reserve the right to change which features are free or Premium, introduce new Premium features, remove features, modify feature availability, or change feature names, provided that we do so in accordance with applicable law and platform requirements.
Lifetime Access applies only to the GeoSwipe app and to the paid features included within GeoSwipe that we choose to make available under Lifetime Access. Lifetime Access does not guarantee access to separate apps, future standalone products, separate paid services, major new services, or features that are clearly offered as separate paid products.
FEES
GeoSwipe may charge fees for Premium features, subscriptions, Lifetime Access, future updates, or additional services.
Any price, billing period, renewal term, free trial, introductory offer, promotional offer, or paid feature description will be displayed before you confirm a purchase through Apple’s in-app purchase system.
We reserve the right to adjust pricing, modify available plans, introduce new paid features, remove paid features, or change purchase options from time to time. Where required by law or Apple policy, you will be provided with advance notice of material subscription price changes.
Your statutory consumer rights remain unaffected.
ACCOUNTS, PERSONAL IDENTIFIERS, AND DATA STORAGE
GeoSwipe operates without user accounts and does not require you to provide personal identifiers such as your name, email address, or contact details to use the App.
Your learning progress, including quiz progress, experience points, levels, ranks, mastered countries, downloaded countries, app settings, and related progress information, is stored locally on your device and, if enabled, within your private iCloud account linked to your Apple ID. We do not have access to, or control over, your private iCloud learning progress, nor is it transmitted to or stored on our own servers.
All iCloud storage and synchronisation functions are provided and governed by Apple Inc. under Apple’s applicable terms, policies, data handling practices, and support procedures. We do not accept responsibility for Apple’s handling of your iCloud data.
GeoSwipe does not use live AI features inside the App. Users cannot submit prompts or chat with an AI system through GeoSwipe, and the App does not send user-provided information or in-app activity to AI services for live processing.
Some educational content in GeoSwipe may have been created, assisted, reviewed, edited, organised, or summarised using AI tools before being included in the App. This does not involve processing your personal data inside the live App.

SUBSCRIPTION, MEMBERSHIP & RENEWAL
GeoSwipe may offer paid access through Apple’s in-app purchase system. This may include a yearly auto-renewing subscription, a one-time Lifetime Access purchase, free trials, introductory offers, promotional offers, or other purchase options shown in the App.
All subscriptions, payments, renewals, cancellations, refunds, and billing enquiries are managed exclusively through Apple’s in-app purchase system. We do not directly process payments or hold your billing information.
Yearly Subscription: If you purchase a yearly subscription, you will receive access to the Premium features included with that subscription for the subscription period shown at purchase. The subscription will renew automatically unless cancelled through your Apple ID subscription settings before the renewal date, in accordance with Apple’s App Store terms.
Free Trial: From time to time, we may offer a free trial for the yearly subscription. If a free trial is offered, the trial duration and renewal terms will be shown before you confirm the subscription. Unless you cancel at least 24 hours before the trial ends, your paid subscription may begin automatically at the end of the trial, and Apple may charge the applicable subscription price to the payment method linked to your Apple ID.
Managing or Cancelling a Subscription: You may manage or cancel your subscription at any time through your Apple ID subscription settings. Cancellation will take effect in accordance with Apple’s terms. You will generally retain access to subscription features until the end of the current billing period, unless Apple’s terms or a specific offer state otherwise.
Lifetime Access: GeoSwipe may offer a one-time Lifetime Access purchase. Lifetime Access is intended to unlock applicable Premium features in GeoSwipe without recurring subscription payments, subject to these Terms, Apple’s terms, refund status, entitlement status, technical availability, third-party service availability, platform requirements, and continued availability of the App. For clarity, “Lifetime Access” means access to eligible Premium features within GeoSwipe for the lifetime of the GeoSwipe app and service, not for the lifetime of any individual user. Lifetime Access does not guarantee that GeoSwipe, any particular feature, content item, database, image, audio file, map, quiz, comparison tool, offline download, or third-party service will remain available indefinitely. If GeoSwipe is discontinued, withdrawn, materially restructured, no longer technically viable, no longer commercially viable, or removed from the App Store, Lifetime Access may end or certain Premium features may become unavailable. Where reasonably practicable, we may provide notice, continued access for a limited period, offline access, replacement features, alternative access, or other reasonable measures, but we do not guarantee indefinite access to GeoSwipe or any specific Premium feature. Nothing in this section affects your statutory consumer rights.
Subscription and Lifetime Access Overlap: A yearly subscription and Lifetime Access are separate Apple in-app purchase products. If you purchase Lifetime Access while you also have an active yearly subscription, the Lifetime Access purchase does not automatically cancel your subscription. You are responsible for managing or cancelling any active subscription through your Apple ID subscription settings if you no longer want it to renew.
Entitlement Management: GeoSwipe uses RevenueCat to help manage subscription status, Lifetime Access status, restore purchases, entitlement status, and access to paid features. If Apple or RevenueCat reports that your subscription, Lifetime Access, or other entitlement is inactive, expired, refunded, revoked, cancelled, or otherwise invalid, access to Premium features may be removed and the paywall may reappear.
Refunds and Billing Enquiries: All billing, payment processing, and refund requests are administered by Apple under Apple’s applicable App Store terms and refund policies. We do not have the technical or legal capacity to issue refunds or alter Apple billing records directly. Refund and billing queries should be directed to Apple Support.
Your statutory consumer rights under UK law remain unaffected by these Terms.
PAYMENT, RENEWALS, AND REFUND POLICY (APPLE)
Payment Processing: All payments for GeoSwipe are processed through Apple’s App Store in-app purchase system. By confirming a purchase, you authorise Apple to charge the applicable price to the payment method linked to your Apple ID. We do not collect, process, or store your payment card details.
All prices are displayed in your local currency where supported and may include applicable taxes where required by law. Any applicable charges, renewal rates, trial terms, promotional offers, or introductory offers will be shown before you confirm your purchase.
Automatic Renewals: Yearly subscriptions renew automatically at the end of each subscription period unless cancelled in accordance with Apple’s terms. Unless you cancel before the renewal date, Apple may automatically charge your account for the next subscription period using the payment method linked to your Apple ID.
Free Trials and Conversion to Paid Subscription: If a free trial is offered for a yearly subscription, you may cancel during the trial period in accordance with Apple’s terms. If you do not cancel before the applicable deadline shown by Apple, your paid subscription may begin automatically when the trial expires.
Lifetime Purchase: Lifetime Access is a one-time in-app purchase. It is not a subscription and does not renew automatically. Lifetime Access is subject to these Terms, App Store rules, technical availability, refund status, entitlement status, and continued availability of the App.
Refunds and Disputes: As all payments are managed by Apple, refunds, billing disputes, and payment issues are handled directly by Apple Support in accordance with Apple’s App Store Terms and Refund Policy. We do not have the technical or legal capacity to issue refunds or alter billing records on your behalf.
If a purchase is refunded, reversed, revoked, cancelled, or otherwise invalidated, access to the relevant paid features may be removed. Offline downloaded content and Premium-only features may become inaccessible when your Premium entitlement is no longer active.
If you believe you have been billed in error or wish to request a refund, please contact Apple Support through your purchase history or Apple’s billing support channels.
We reserve the right to adjust pricing, modify available subscription plans, modify Lifetime Access pricing, introduce new purchase options, or update associated terms as necessary. Where required by law or platform policy, Apple may provide you with advance notice of material subscription price changes. Continued use of the App following such notice constitutes acceptance of the updated terms, subject to your statutory rights.
THIRD-PARTY SERVICES AND CONTENT
GeoSwipe relies on certain trusted third-party services, platforms, content sources, software tools, and infrastructure providers to operate securely and deliver key features. These integrations are used where necessary to support the App’s functionality, content delivery, purchases, reliability, and user experience.
Apple: The App is distributed and managed through the Apple App Store. Apple processes in-app purchases, subscriptions, renewals, refunds, iCloud services, device-level settings, and related platform services. Your use of Apple services is subject to Apple’s own terms and privacy policies.
Firebase: GeoSwipe uses Firebase services to deliver country guide content, images, audio files, and related app functionality. Firebase may process technical information necessary to provide these services, as described in the GeoSwipe Privacy Policy.
RevenueCat: GeoSwipe uses RevenueCat to manage yearly subscription status, Lifetime Access status, restore purchases, entitlement status, and Premium access.
Maps, Images, Audio, and Source Materials: GeoSwipe may use third-party map resources, royalty-free or licensed images, text-to-speech tools, public information sources, public databases, reference materials, and other third-party content or software tools to prepare, display, or support educational content.
Analytics and Diagnostics: GeoSwipe may use limited analytics, diagnostic, and performance tools as described in the GeoSwipe Privacy Policy. These are used to improve stability, performance, content delivery, purchase management, and reliability.
We do not sell, trade, or share your personal information with third parties for advertising or behavioural profiling purposes.
Third-party services and content are subject to their own terms, licences, privacy notices, availability, and technical limitations. We are not responsible for third-party services, outages, errors, licensing changes, pricing changes, content changes, or data handling outside our reasonable control.
USAGE, EDUCATIONAL, AND GEOGRAPHY DISCLAIMER
GeoSwipe is designed to support geography learning, general knowledge, and educational exploration. The App is intended solely for general educational and informational use.
Educational Purpose: All content, guidance, maps, country descriptions, images, audio, quizzes, comparisons, graphs, rankings, statistics, and learning materials provided through GeoSwipe are for general educational purposes only. GeoSwipe is not an official government, legal, political, academic, travel, immigration, safety, financial, or professional advisory service.
No Professional Advice: Content in GeoSwipe should not be treated as professional advice of any kind. You should not rely on GeoSwipe for legal, political, travel, financial, immigration, safety, academic, professional, or other important decisions. You should verify important information with official or authoritative sources before relying on it.
Accuracy and Updates: We aim to provide accurate, useful, and well-referenced educational content. However, country information changes over time and may be incomplete, outdated, simplified, disputed, mistranslated, incorrectly sourced, incorrectly summarised, or otherwise inaccurate. This may include, without limitation, information about population, capitals, governments, currencies, languages, borders, regions, territories, economies, histories, cities, cultures, infrastructure, and international status.
AI-Assisted Content: Some country guide content, quiz content, summaries, explanations, audio scripts, comparisons, or other educational materials may have been created, assisted, organised, summarised, or edited using AI tools before inclusion in the App. AI-assisted content may contain errors, omissions, oversimplifications, outdated information, or inaccurate wording. Users should exercise independent judgement when interpreting or relying on the App’s content.
Maps, Borders, Territories, and Political Status: Maps, borders, country names, flags, capitals, territories, regions, administrative divisions, disputed areas, political descriptions, and similar content are provided for general educational purposes only. Their inclusion, exclusion, naming, colouring, boundary depiction, classification, or description does not imply any political position, recognition, endorsement, approval, or opinion by ELM APPS LTD.
Disputed and Sensitive Regions: Some countries, territories, borders, regions, or political statuses may be disputed, sensitive, contested, or recognised differently by different governments, organisations, communities, or international bodies. GeoSwipe may use simplified or practical educational representations and may not reflect every viewpoint, claim, legal status, or political position.
Sensitive, Political, Cultural, and Historical Content: GeoSwipe may include educational content about countries, territories, peoples, governments, borders, flags, conflicts, histories, religions, cultures, languages, ethnic groups, disputed areas, political systems, independence movements, and other sensitive or contested subjects. We aim to present such content in a neutral, educational, respectful, and source-informed manner. However, users, governments, organisations, communities, or individuals may disagree with particular wording, classifications, omissions, emphasis, sources, images, maps, borders, comparisons, rankings, terminology, or interpretations. The inclusion, exclusion, wording, classification, display, comparison, or description of any country, territory, people, government, border, flag, region, conflict, historical event, cultural practice, or political status does not imply endorsement, opposition, recognition, denial, approval, disapproval, or any political, religious, cultural, ideological, or legal position by ELM APPS LTD. GeoSwipe may use simplified educational summaries and practical learning representations. Such content may not reflect every viewpoint, claim, legal position, historical interpretation, political position, cultural perspective, or community preference. If you believe any content is inaccurate, outdated, incomplete, offensive, culturally insensitive, politically misleading, misattributed, or otherwise problematic, you may contact us at support@elmapps.co.uk. We may review, amend, remove, replace, restrict, clarify, or update the relevant content at our discretion, subject to applicable law, platform requirements, editorial judgement, and technical feasibility.
Regional Maps and Quizzes: Regional maps and regional quizzes may not be available for every country. Where available, they may be simplified, incomplete, outdated, approximate, or based on selected administrative divisions. They are intended for learning and entertainment, not legal, governmental, surveying, navigation, or official reference purposes.
Images: Images in GeoSwipe are intended to be illustrative and educational. Images may not always show the exact location, region, building, landscape, people, culture, or country being discussed. Some images may be representative, approximate, generic, or incorrectly matched. Image inclusion does not imply endorsement by the photographer, source, platform, person, property owner, government, or community depicted.
Audio: Audio overviews are generated from or based on country guide text and may contain pronunciation errors, omissions, simplifications, timing issues, or audio-generation artefacts. Audio content is provided for convenience and educational listening only.
Country Comparisons and Graphs: Country comparison tools, interactive graphs, rankings, statistics, and data visualisations are intended to make learning more engaging. Data may be approximate, simplified, delayed, rounded, sourced from third-party public datasets, or unavailable for some countries. Comparisons should not be treated as definitive or professional analysis.
User Discretion and Responsibility: Users remain solely responsible for how they interpret and use GeoSwipe content. ELM APPS LTD, its developers, owners, affiliates, licensors, and service providers shall not be liable for decisions, actions, misunderstandings, losses, or consequences arising from reliance on GeoSwipe content, except where liability cannot be excluded under applicable law.
USER CONTENT, FEEDBACK, AND OWNERSHIP
GeoSwipe does not provide public user profiles, public posting features, or user-generated country guide publishing tools.
GeoSwipe may allow you to submit optional feedback about country guides, content quality, errors, images, quizzes, or App functionality. Feedback may include ratings, tags, comments, the relevant country name, the relevant country ISO code, timestamps, and related technical context.
Feedback submissions are intended to help us improve, correct, and develop GeoSwipe. Unless you voluntarily include personal information in your feedback, feedback is intended to be anonymous. You should not include sensitive personal information, confidential information, offensive content, unlawful content, or third-party personal information in feedback submissions.
You retain any rights you may have in feedback you submit. However, by submitting feedback, you grant ELM APPS LTD a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable, non-exclusive licence to use, store, review, reproduce, modify, summarise, analyse, publish, implement, and otherwise exploit that feedback for the purposes of improving, correcting, developing, operating, marketing, and supporting GeoSwipe and related products or services, without payment, attribution, or further approval from you.
We are not obliged to act on feedback, respond to feedback, preserve feedback, attribute feedback, or compensate you for feedback.
LICENCES YOU GRANT TO GEOSWIPE
By using GeoSwipe, you grant us a limited, non-exclusive, revocable licence to process technical and app-related data as necessary to provide, operate, maintain, secure, and improve the App, in accordance with these Terms and the GeoSwipe Privacy Policy.
This licence may include processing information necessary to:
- display App content and features;
- store learning progress locally on your device and, where enabled, in your private iCloud account;
- deliver guide content, images, and audio;
- provide quizzes, mini-games, rankings, comparisons, and interactive graphs;
- manage subscriptions, Lifetime Access, entitlements, and restore purchases;
- receive and process optional feedback;
- provide support;
- maintain security, reliability, and performance;
- comply with applicable law.
We do not claim ownership of your private learning progress. Your local and iCloud-stored App data remains under your control, subject to Apple’s platform rules and your device/iCloud settings.
Where you submit feedback, the licence in the "User Content, Feedback, and Ownership" section applies.
USER RESPONSIBILITIES
By using GeoSwipe, you agree to use the App responsibly, lawfully, and in accordance with these Terms.
You agree that you will:
- use the App only for personal, non-commercial use unless we expressly authorise otherwise in writing;
- comply with all applicable laws and regulations;
- respect all intellectual property rights in the App and its content;
- maintain the security of your device, Apple ID, subscription access, and purchase credentials;
- provide accurate and lawful information when contacting support or submitting feedback;
- use educational content responsibly and verify important information through official or authoritative sources where necessary;
- manage your subscriptions, cancellations, refunds, and purchases through Apple where applicable;
- not share access to Premium features in an unauthorised way;
- not misuse the App, its systems, or its content.
You are solely responsible for how you interpret and apply the information, quizzes, comparisons, maps, graphs, and educational materials provided through GeoSwipe.
ACCEPTABLE USE
To protect the App, its content, and other users, the following actions are prohibited:
- using the App for any unlawful, harmful, abusive, fraudulent, or misleading purpose;
- submitting feedback that is offensive, unlawful, defamatory, discriminatory, threatening, harassing, obscene, misleading, malicious, or infringes the rights of others;
- attempting to interfere with, compromise, overload, bypass, disrupt, or damage the App’s security, performance, systems, paywall, entitlement checks, databases, content delivery, or infrastructure;
- attempting to bypass, disable, manipulate, or avoid subscription, Lifetime Access, purchase, entitlement, or paywall controls;
- copying, scraping, crawling, harvesting, extracting, bulk-exporting, downloading, redistributing, republishing, selling, licensing, or otherwise exploiting App content without permission;
- using any robot, scraper, crawler, automated tool, script, data extraction method, or similar process to access, collect, monitor, or copy App content or data;
- using GeoSwipe content, guides, maps, quizzes, images, audio, data, comparisons, graphs, metadata, or databases to train, fine-tune, evaluate, benchmark, or develop artificial intelligence systems, machine learning models, datasets, or similar technologies without our prior written consent;
- reverse engineering, decompiling, disassembling, modifying, translating, adapting, or creating derivative works based on the App, except where permitted by law;
- attempting to access source code, hidden endpoints, databases, private APIs, Firebase resources, RevenueCat configuration, or other systems not intended for public access;
- removing copyright, trademark, attribution, source, licensing, or proprietary notices;
- using the App or its content for commercial research, competing products, content databases, map databases, training datasets, or bulk educational products without permission;
- impersonating another person or misrepresenting your identity when contacting us;
- using the App in a way that breaches Apple’s terms, these Terms, or applicable law.
Violation of these Terms may result in suspension, restriction, or termination of access to the App or Premium features, subject to applicable law and Apple platform rules.
GEOSWIPE CONTENT AND INTELLECTUAL PROPERTY
GeoSwipe contains educational content, software, designs, country guides, guide structures, quiz questions, explanations, learning games, images, audio, maps, regional materials, comparison tools, interactive graphs, data visualisations, layouts, metadata, databases, UI elements, trademarks, trade names, logos, and other materials.
The App’s software, design, structure, compilation, selection, arrangement, presentation, metadata, guide database, quiz database, audio content, data visualisations, learning flow, and other original elements are protected under UK and international intellectual property, copyright, database, trademark, and related rights. All rights are reserved by ELM APPS LTD and its licensors.
Some content may be based on, derived from, compiled with reference to, or supported by public sources, licensed resources, royalty-free resources, third-party datasets, third-party images, map resources, open-source tools, text-to-speech tools, or other third-party materials. Such materials remain subject to their respective rights, licences, and terms.
References, citations, source notes, or acknowledgements may be included in the App where reasonably appropriate. However, the presence or absence of a citation does not guarantee accuracy, completeness, endorsement, or legal status.
You are granted a personal, limited, revocable, non-exclusive, non-transferable licence to use GeoSwipe and its content within the App for personal, non-commercial educational purposes only.
You must not, without our prior written consent or except as permitted by law:
- copy, reproduce, redistribute, republish, sell, rent, sublicense, or commercially exploit any part of the App or its content;
- extract, scrape, download, crawl, bulk-export, or compile any App content, database, guide, quiz, image, audio, map, graph, comparison, metadata, or source material;
- perform text or data mining of the App’s contents;
- use App content to train, fine-tune, test, evaluate, benchmark, or develop AI or machine learning systems;
- create derivative works based on the App, its guide database, quiz database, audio files, images, maps, graphs, comparisons, or data;
- reverse engineer, decompile, disassemble, modify, or adapt the software;
- remove or obscure proprietary notices, source notices, copyright notices, or attribution notices;

We will review the matter and, where appropriate, amend, remove, replace, or restrict access to the relevant material.
CHILDREN PRIVACY
GeoSwipe is not directed to children under 16 years of age.
If you are under 16, you should use GeoSwipe only with the consent and supervision of a parent or legal guardian, where required by applicable law. Parents and guardians are responsible for supervising children’s use of the App and determining whether the App is suitable for them.
We do not knowingly collect personal information directly from anyone under 16. If we become aware that we have inadvertently collected personal information from a child in a way that requires deletion or other action under applicable law, we will take appropriate steps in accordance with the UK GDPR, the Data Protection Act 2018, and other applicable laws.

DATA PROTECTION & THE UK/EU GDPR
We take privacy and data protection seriously. GeoSwipe is designed to minimise personal data collection and to operate in compliance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
The App does not require registration, and we do not ask for personal identifiers such as your name, email address, precise location, contacts, photos, or profile information to use the App.
Your learning progress, quiz progress, levels, ranks, downloaded countries, and app settings remain on your device and, if enabled, are synchronised through Apple’s iCloud service. We do not access or store this private iCloud learning progress on our own servers.
GeoSwipe uses third-party services such as Apple, Firebase, and RevenueCat to provide App distribution, iCloud functionality, content delivery, purchases, subscriptions, entitlements, analytics, and service reliability. Further information is provided in the GeoSwipe Privacy Policy.
We do not sell your personal data, use third-party advertising SDKs, or use behavioural advertising tracking.

DATA SECURITY AND RETENTION
We are committed to keeping information secure, private, and within your control where possible. GeoSwipe has been developed with a privacy-conscious approach, meaning that personal data collection and processing are kept to the minimum reasonably necessary for the App to function.
Your learning progress and app data are stored locally on your device and, if enabled, within your private iCloud account linked to your Apple ID. This storage is governed by Apple’s security standards, your Apple settings, and your device security choices.
Data transmitted between the App and service providers such as Apple, Firebase, and RevenueCat is protected using secure network communication such as HTTPS/TLS where applicable.
We do not create public user profiles or require accounts. We do not host your private learning progress on our own servers.
If you contact us directly, submit feedback, or request support, we may retain minimal correspondence and feedback records solely to handle your query, improve the App, maintain records, or comply with applicable law. Such data will be retained only for as long as reasonably necessary.
You remain responsible for maintaining appropriate security measures on your own device and Apple account, including passcodes, Face ID or Touch ID, two-factor authentication, and backups.
LIMITATION OF LIABILITY
To the fullest extent permitted by UK law, GeoSwipe and all related content, features, databases, guides, maps, quizzes, images, audio, comparisons, graphs, and services are provided on an “as is” and “as available” basis.
We make no express or implied representations, warranties, or guarantees regarding the App’s accuracy, reliability, availability, suitability, completeness, timeliness, merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation, except where such warranties cannot be excluded under applicable law.
While we take care to prepare useful educational content and maintain the App, we do not warrant that:
- the App or its content will be uninterrupted, error-free, secure, or free from defects;
- country guides, maps, borders, flags, regions, facts, quiz answers, images, audio, comparisons, graphs, or statistics will always be accurate, complete, current, or suitable for every purpose;
- AI-assisted or AI-supported content preparation will be free from errors, omissions, bias, inaccuracies, or outdated information;
- third-party services such as Apple, Firebase, RevenueCat, image providers, map providers, content sources, or other service providers will always be available, accurate, secure, or error-free;
- offline downloads will always remain accessible, complete, current, or compatible;
- Premium features will always remain exactly the same over time;
- the App will meet your personal expectations, learning goals, academic requirements, travel needs, or professional needs.
You acknowledge that GeoSwipe is educational and informational only. Decisions based on the content of the App are made at your own discretion and risk.
To the fullest extent permitted by law, ELM APPS LTD, its directors, employees, contractors, affiliates, licensors, and service providers shall not be liable for indirect, incidental, special, consequential, punitive, or economic losses, including loss of data, loss of profits, loss of goodwill, loss of opportunity, loss of access, content errors, inaccurate information, service interruptions, or reliance on App content.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under English law, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or your statutory consumer rights.
Your statutory rights as a consumer remain unaffected.
TERMINATION AND SUSPENSION OF SERVICE
We may suspend, restrict, modify, or discontinue access to GeoSwipe, in whole or in part, where reasonably necessary to:
- maintain or improve performance, reliability, functionality, or security;
- comply with law, regulation, legal obligation, platform requirement, or valid governmental request;
- address suspected misuse, abuse, fraud, unauthorised access, scraping, paywall bypass, or breach of these Terms;
- correct errors, update content, or improve educational quality;
- address intellectual property, licensing, image, map, source, or content concerns;
- perform essential maintenance or updates;
- manage third-party service outages, pricing changes, or availability issues;
- protect ELM APPS LTD, users, service providers, or third-party rights.
If your yearly subscription lapses, expires, is cancelled, payment fails, or Apple or RevenueCat reports your entitlement as inactive, access to Premium features may end at the close of the applicable subscription period or at another time determined by Apple’s terms and entitlement status.
If your Lifetime Access purchase is refunded, reversed, revoked, cancelled, or otherwise invalidated, access to Premium features may end and the paywall may reappear.
Where Premium access ends, offline downloads and Premium-only content may become inaccessible, even if previously downloaded.
You may terminate your use of the App at any time by cancelling any active subscription through Apple’s subscription settings, deleting the App from your device, or ceasing to use the App.
Upon termination:
- your licence to use the App will end, except for any rights that must continue under applicable law;
- locally stored app data may remain on your device unless you delete it;
- iCloud-stored app data may remain in your private iCloud account unless you delete it through Apple’s settings;
- Premium features may become inaccessible if your entitlement is inactive;
- we will not retain copies of your private iCloud learning progress on our own servers, as we do not host that data.
We are not responsible for any loss of access, loss of local data, loss of iCloud data, or loss of downloaded content resulting from your decision to uninstall the App, delete App data, cancel a subscription, receive a refund, change devices, disable iCloud, or change Apple account settings, except where required by law.
TAKE-DOWN, CORRECTION, AND CONTENT CONCERN NOTICES
If you are a user, copyright owner, rights holder, authorised agent, photographer, publisher, source provider, licensor, community representative, or other concerned party and believe in good faith that any material provided through GeoSwipe is inaccurate, outdated, incomplete, misattributed, offensive, culturally insensitive, politically misleading, infringing, unlawful, or otherwise problematic, please contact us in writing at:
Please include enough information for us to identify the relevant material, the nature of your concern, your rights or authority where applicable, your reasons for raising the concern, and your contact details.
We will review valid notices and, where appropriate, may amend, remove, replace, restrict, attribute, clarify, or update the relevant material. We may also request additional information before taking action.
Submitting a notice does not guarantee that content will be removed or changed. GeoSwipe may retain, update, contextualise, or replace content where we believe this is appropriate for educational, legal, technical, editorial, or user-experience reasons, subject to applicable law.
We reserve the right to prioritise urgent legal, safety, privacy, intellectual property, or serious accuracy concerns.
APPLE THIRD-PARTY BENEFICIARY
If you downloaded GeoSwipe from the Apple App Store, Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and may enforce Apple’s Standard EULA against you.
Except as stated in this section, no other party has rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
GOVERNING LAW AND JURISDICTION
These Terms, the GeoSwipe mobile application, and any related Services shall be governed by the laws of England and Wales.
The parties agree to submit to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection laws require otherwise.
This is without prejudice to the right of ELM APPS LTD and its affiliates to commence proceedings anywhere in the world relating to the protection of intellectual property rights, database rights, confidential information, App security, unauthorised scraping, unauthorised copying, or the rights of its licensors.
